Course content
Themes: Law. System of law. Legal standards. Creation of law. Czech law. The constitutional system of the Czech Republic. Protection of human rights in Czech and international law. Status of judges and courts. The position of the Ombudsman.

Learning outcomes
The aim of the course Theory of Law is to gain knowledge about the law, the emergence of law, legislative proceedings, system of law, sources of law, legal rules, legal matters, forms of legal acts, the constitutional order of the Czech Republic, the legislative, executive and judiciary powers, human rights and freedoms - Charter of fundamental rights and freedoms, protection of human rights - the Ombudsman.
After completing the course, students should be able to understand the following topics: Law - the notion of law, objective and subjective law, positive law and natural law, law and legal consciousness, sources of law in the formal and material sense. System of law - private and public law, substantive law and procedural law, private and public method of legal regulation Legal standards - the issue of normativity, mods of normativity and their application in law, specific features of legal norms, the structure of legal norms, classification of legal norms. Force of legal norms - factual, spatial, temporal and personal force of legal norms and the issue of retroactivity in the creation and application of law, national law, European law. Creation of law - the legislative process, judicial law. Czech legal order - the system and the division of the Czech legal order. Terms of force and efficiency of acts, implementing legislation and international treaties. Czech constitutional system - the basic provisions of the Constitution of the Czech Republic, status and relationships of the President, government and Parliament. The issue of elections. Protection of human rights in Czech and international law - the contents of the Charter of Fundamental Rights and Freedoms and of key international human rights documents. The status of judges and the courts - the status of judges and constitutional judges, the system and the functioning of the ordinary courts and the Constitutional Court, the basic principles of judicial proceedings. The position of Ombudsman - the scope and means of action of the Ombudsman.

PC skills, ability to find actual legislation in the Collection of Laws of the Czech Republic and the Collection of International Treaties published in a manner allowing remote access.
